Dyletswydd Gofal

Cyngor ynghylch rhoi eich gwastraff i bobl eraill.

Os oes gennych wastraff mae gennych 'Ddyletswydd Gofal' cyfreithiol. Mae'r Ddyletswydd Gofal yn berthnasol i bawb sy'n gysylltiedig â thrafod y gwastraff:

  • o'r sawl sy'n ei gynhyrchu
  • i'r sawl sy'n ei waredu neu ei adfer yn derfynol.

Dyletswydd Gofal yw un o'r prif ffyrdd o ymladd yn erbyn tipio anghyfreithlon.

Rhoi eich gwastraff i bobl eraill

Mae rhai rheolau syml i'w dilyn gan gynnwys cadw'ch gwastraff yn ddiogel fel nad yw'n gollwng nac yn chwythu i ffwrdd ac os ydych yn rhoi eich gwastraff i rywun arall (fel contractwr gwastraff), eich dyletswydd chi yw sicrhau eich bod yn:

  • gwirio bod yr unigolyn yn gallu'i gymryd - gofynnwch iddynt am dystiolaeth eu bod wedi'u hawdurdodi i gludo gwastraff. Os na allant wneud hyn, peidiwch â rhoi eich gwastraff iddynt - cysylltwch ag Asiantaeth yr Amgylchedd ar 03708 506 506. 
  • sicrhau bod y gwastraff yn mynd i safle priodol - yn drwyddedig neu'n eithriedig
  • rhoi nodyn trosglwyddo i'r unigolyn - mae'n rhaid i hwn gynnwys disgrifiad o'r gwastraff a'i fod wedi'i lofnodi gan y ddau ohonoch. Cadwch gopïau o'ch nodiadau trosglwyddo am o leiaf ddwy flynedd.
  • O’r 28ain o Fedi ymlaen, sicrhewch lofnodi datganiad ar y ffurflen drosglwyddo er mwyn dangos fod y drefn dewisiadau rheoli gwastraff wedi’i dilyn.

Oherwydd newidiadau tan Reoliadau Gwastraff (Cymru a Lloegr) 2011, bydd yr wybodaeth y mae angen iddi fod ar ffurflen trosglwyddo gwastraff yn newid: felly ymhen amser, disodlir y copi o’r ffurflen drosglwyddo isod.

On 19 March government announced plans to streamline environmental legislation. Among the measures proposed was a suggestion that in the future other forms of evidence (for example, invoices) may be acceptable to record information covering the transfer of waste instead of requiring separate waste transfer notes. Government will be considering options and consulting on these later this year. In the meantime waste transfer notes must be completed as usual.

Government guidance

Defra has produced statutory guidance for the Duty of Care (ISBN 011753210X). Download a copy from this page, or call the Stationery Office bookshops on 08706 005 522.

Government are planning to consult on a new Code of Practice sometime in 2013 and make amendments to the Code of Practice following this consultation. At this time the Code of Practice here will be replaced by the new Code. The Code will continue to have a statutory role and will be applicable within England and Wales.

National electronic duty of care programme (edoc)

EU Life+ logoThe edoc programme aims to modernise the way waste data is collected in the UK. It will create a national web-based system to capture information from production to collection, transportation, treatment and disposal of waste. The new system will help businesses by moving from the current paper based system of waste transfer notes and make it easier for them to understand how their waste is handled.
